Advertising Terms and Conditions Conditions of
advertisement whereby the Advertiser is bound by
the following principles, terms and regulations
stated and laid down by the Publisher.
1. All advertisements placed by the Advertiser
are the sole responsibility of the Advertiser in
respect of accuracy and adherence to the laws and
policies of the Malaysia Government and other relevant
official bodies of the country where the magazine
is published and compiled.
2. In respect of Clause 1, the Publisher will
be guaranteed of indemnification in whatever nature
preferred of requested by the Publisher, action,
costs and expenses arising out of the Advertisers
advertisement.
3. Rates are agreed upon the understanding that
the space ordered is and within the period of the
order. Should the Advertiser fail to use the total
space ordered within the period stated, the Publisher
reserves the right to amend the rate to coincide
with the rate currently applied.
4. Block bookings for the chosen number of issues
booked over a maximum period of one year protect
the Advertiser to hold the rate at which the booking
was made. Should the Advertiser elect to cancel
one advertisement within this block, all advertisements
concerned in this booking block will still be protected
and invoiced at the lower appropriate discount
rate. However, should the Advertiser elect to cancel
more than one advertisement within the booking
block, rate protection will be nullified and the
current casual rate will apply with immediate effect.
5. Under no circumstances, whatsoever, will the
placing of any order confer any right to renew
on similar terms. The Advertiser is held solely
responsible for supplying advertisement material
within the time agreed upon.
6. When advertisement material is overdue, the
Publisher reserves the right to repeat previous
advertisement material which will be charged at
current applicable rates or where there is no previous
advertisement material, the Publisher reserves
the right to run the space ordered however the
Publisher sees or deems fit.
7. Requests for preferred placement of advertisements
can only be guaranteed with payment of the appropriate
loading fee(s). Otherwise, all advertisements will
be placed ROP (Run of Page).
8. Should any advertisement material supplied
be incomplete, incorrect or does not comply with
our material requirements for print, the Publisher
reserves the right to proceed with the necessary
adjustments, with or without notice or consultation
with Advertiser. All adjustment costs(s) incurred
will be borne by the Advertiser
9. The Publisher reserves the right to revise
advertisement rates at any given time or to amend
the terms of contract pertaining to space booking
or frequency of insertions. In respect of this,
the Advertiser reserves the option of cancelling
the balance of the contract without prejudice and
penalty.
10. Credit accounts are strictly nett and must
be settled within a period of 30 days. If an account
is overdue, the Publisher reserves the right to
suspend insertions. A delinquency charge of 5%
per month will be charged on any account, outstanding
for more than 30 days from the date of invoice.
11. All payment(s) must be made in Malaysian Ringgit,
Singapore Dollars or US Dollars respectively or
in equivalent according to the prevalent official
rate of exchange.
12. The Advertiser will be held solely responsible
for the insurance of all advertisement material
delivered by the Advertiser to the Publisher.
13. The Publisher reserves the right to destroy
all advertisement material and other materials
which have been held in storage for more than 6
months, without giving further notice to the Advertiser,
provided that the Advertiser or his agent, has
given instructions to the contrary. Any requests
for the return of advertisement material(s) or
any other material must be submitted in writing.
14. The Publisher shall take all care to ensure
accuracy and quality but will not be liable for
clerical or printer’s error or their consequences
however caused and no responsibility whatsoever
will be accepted where publication is delayed or
prevented by factors beyond the control of the
Publisher.
15. Advertisements placed by the Advertiser will
not be reliant on supporting editorial by the Publisher.
Any submission by the Advertiser for editorial
will be used and published at the Publisher’s
discretion.
16. The Publisher reserves the right to decline,
amend and withdraw any advertisement without any
explanation to the Advertiser.
17. The Publisher reserves the right to impose
a 100% cancellation fee in the event of delayed
advertisement material or late cancellation. All
requests for cancellation of advertisements must
be submitted in writing and given 3 month’s
(1 issue) notice from the publication issue. Front
cover cancellations must be given 6 month’s
(2 issues) notice from the publication issue.
